1. Agreement to use MovieNight

This document is the combined Terms of Service and Privacy Policy ("Terms") for MovieNight, operated by Meloku, LLC ("MovieNight," "we," "us," or "our"). By creating an account, subscribing, or using MovieNight, you agree to these Terms. If you do not agree, do not use the service.

2. What the service provides

MovieNight offers movie discovery, ranking, personal account tools, lists, recommendations, friend groups, and subscription-based software services. Features, availability, pricing, interfaces, and content sources may change, be limited, or be removed at any time.

The service is provided on an ongoing software-as-a-service basis and is not promised to remain identical over time.

3. Eligibility and age requirement

You must be at least 13 years old to create an account or use MovieNight. MovieNight is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it.

4. Accounts and eligibility

You are responsible for the accuracy of the information you provide, for access to your email address or phone number, and for activity that occurs through your account. You must not impersonate another person, misuse verification flows, or interfere with other users or the platform.

5. Subscription billing

Paid features are billed on a recurring basis unless canceled. Trials, promotional pricing, renewal timing, taxes, and billing intervals may vary by plan. By subscribing, you authorize recurring charges through the payment method on file until cancellation takes effect.

Unless required by law, fees are non-refundable after a billing period begins. We may change plan features or pricing prospectively, and continued use after the effective date of a change constitutes acceptance of the updated pricing or plan terms.

6. Text messages and email notices

If you provide a phone number, carrier details, or choose phone-based authentication or notification features, you consent to receive transactional text messages related to account access, verification, security, and service operations. Message frequency varies. Message and data rates may apply. Carrier participation and message delivery are not guaranteed.

You agree that you are authorized to receive messages at the number you provide and that you will keep your phone and carrier information current. Email may also be used for sign-in, account notices, receipts, product updates, and legal communications.

7. Acceptable use

You may not use the service to abuse rate limits, scrape protected data, disrupt the platform, bypass billing or access controls, upload unlawful material, or violate applicable law or third-party rights.

8. Your content

You retain ownership of the reviews, ratings, lists, avatars, and other content you submit ("Your Content"). By submitting Your Content, you grant MovieNight a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely to operate, provide, and improve the service (for example, showing your review to other users or your lists to friends you share them with).

You are responsible for Your Content and represent that you have the right to submit it. We may remove Your Content if it violates these Terms or applicable law.

9. Third-party services and content

MovieNight relies on third-party providers for movie data (The Movie Database), payments (Stripe), file storage (DigitalOcean Spaces), transactional messaging, and analytics/advertising (Google Analytics and Google AdSense). Third-party outages, policy changes, inaccurate metadata, API issues, and delayed deliveries can affect the service, and we are not responsible for third-party systems outside our control.

10. Information we collect

We collect information you provide directly, such as your name, email address, phone number, billing details (processed by Stripe; we do not store full card numbers), profile information, and content you submit (reviews, ratings, lists).

We also collect usage information automatically, such as pages viewed, movies browsed, device/browser type, IP address, and approximate location, through server logs and analytics tools.

11. How we use your information

We use your information to operate and improve the service, process subscriptions and payments, send account and transactional notices, provide customer support, maintain security, measure site usage, and, where enabled, serve and measure advertising.

12. Cookies and tracking technologies

MovieNight uses cookies and similar technologies. Essential cookies (for example, to keep you signed in) are always active because the service cannot function without them.

With your consent, given through the cookie banner shown on the site, we also use:

Analytics cookies (Google Analytics) to understand how the site is used.

Advertising cookies (Google AdSense) to serve and measure ads, which may be based on your prior visits to this and other sites.

You can withdraw consent at any time by clearing the cookie banner choice stored in your browser, and you can opt out of personalized advertising generally through Google's Ads Settings or aboutads.info.

13. How we share your information

We do not sell your personal information. We share information only with service providers who help us operate MovieNight (payment processing, hosting/storage, messaging, analytics, and advertising, as described above), when required by law, or to protect the rights, safety, and property of MovieNight and its users.

14. Data retention

We retain account and content information for as long as your account is active or as needed to provide the service, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated personal information as described below.

15. Your privacy rights

Depending on where you live, you may have the right to access, correct, export, or delete your personal information, and to opt out of certain uses of your data. To exercise any of these rights, contact us through the contact form on the site. We will respond within a reasonable time and may need to verify your identity before fulfilling a request.

16. Security

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

17. Availability and disclaimers

The service is provided on an "as is" and "as available" basis. Downtime, delays, bugs, ranking errors, interrupted access, data issues, and unexpected behavior may happen at any time. We do not guarantee uninterrupted availability, perfect accuracy, fitness for a particular purpose, or that every feature will always work the same way.

18. Limitation of liability

To the fullest extent permitted by law, MovieNight and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or service unavailability arising out of or related to your use of the platform.

19. Indemnification

You agree to indemnify and hold harmless MovieNight and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, Your Content, or your violation of these Terms.

20. Suspension and termination

We may suspend, restrict, or terminate access at any time if we believe an account is abusive, risky, unlawful, unpaid, or otherwise harmful to the service or other users. You may cancel your subscription or request deletion of your account at any time through your account settings or by contacting us.

21. Copyright complaints

If you believe content on MovieNight infringes your copyright, contact us through the contact form with a description of the work, the location of the allegedly infringing material, and your contact information, and we will investigate.

22. Governing law and disputes

These Terms are governed by the laws of the State of Maine, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in Maine.

23. Changes to these terms

We may update these Terms from time to time. When the version changes, we may require renewed acceptance before continued use of some or all features. The latest version will be made available in the app.

24. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms are the entire agreement between you and MovieNight regarding the service and supersede prior agreements on the subject. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
